Seven reasons why an estate must be probated in Massachusetts:
- Property in the name of the decedent can only be transferred into the name of the beneficiary through probate.
- Debts owed to the person who died can be collected by the legal representaive of the estate appointed by the probate court.
- The Last Will and the deceased person’s wishes will be given binding legal effect through the probate process.
- If real estate is to be sold it may be necessary to obtain a license to sell. The license can only be obtained through the probate court.
- Probate will help make sure that all beneficiaries receive their proper shares under the Will.
- Estate tax returns may need to be filed.
